Preparing for Freedom of Information: Processing Requests, Proactive Disclosure, Records and Information Management

Revisiting practices on the preparation of freedom of information (FOI) is crucial. This presentation highlights the importance of recognizing the role of press officers in some countries and designating a nodal point within government to lead the implementation of FOI management.

Information Management and Proactive Disclosure

To institutionalize the implementation of freedom of information effectively, it is important to list public authorities as a way of ensuring that these offices could not declare themselves as private entities to avoid their responsibilities under the right to information (RTI). This presentation shares information on changes that are necessary for more effective RTI implementation.

Anjali Bhardwaj shared India’s experience with its Right to Information Act (RTI) which has been in place for 12 years. Passed in 2005, it is demanded, owned, used, and protected by the people. The passage of the RTI into law came after strong movement from the citizens for legislation. Furthermore, demand for a central law grew as there were RTI laws in 9 states.

Data Protection and Right to Information

Data protection and right to privacy may sometimes come into conflict, but the degree to which these clash depends on the provisions of the laws governing them. This presentation provides actual examples of the conflict arising from different perceptions of what constitutes disclosing personal information and gives specific conditions under which this exemption is granted. It strikes a balance between an individual’s right to privacy and an organization’s obligation to disclose information.
