Mr. Kevin Nash talked about the costs and time involved in international commercial arbitration, noting the differences in costs and time between an institutional arbitration and an ad hoc arbitration. Certain factors, such as the amount in dispute and the number of arbitrators, can affect cost. Similarly, SIAC special procedures, including consolidation of multiple arbitrations, joinder of parties, and early dismissal of claims and defences, as well as institutional measures, such as expedited procedure, arb-med-arb protocol, and appointment of emergency arbitrator, can control costs and timeliness of arbitration proceedings.
