Investment in infrastructure development and other development project is on a significant rise in Nepal in recent years. Thus there is a clear need for a uniform approach in determining compensation and resettlement and rehabilitation of the people who are affected due to land acquisition for the projects. The people of the project area are pushed to the brink of displacement when such projects are executed.

This regulation is enacted, by virtue of the powers conferred to theMinistry by Article 5 of Act no: 4/93 (Environment Protection and Preservation Act), and as stipulated in Article 22 of the MaldivianConstitution, that the State has a fundamental duty to protect and preserve the natural environment, biodiversity, resources and beauty of the country for the benefit of present and future generations.

The Act governs the allocation of Maldivian land for different purposes. It uses other issues regarding the issuing of land, issuing of state dwellings for residential purposes, conduct regarding state dwellings or private dwellings constructed for residential purposes, and the sale, transfer, and lease of Maldivian Land.
