Article 1. The Terms Used In This Code 
In This Code, The Following Definitions Apply: 
1) The Secondary Market Of Land - Transactions Made With The Right To Land, Provided By The Authority; 
2) Buildings And Structures - All Buildings And Structures, Firmly Connected With The Ground, The Movement Is Impossible Without Disproportionate Damage To Their Destination, Including Apartments, Non-Residential Premises In An Apartment Building; 
2-1) Town Planning Documentation - The Documents Of Regional Planning Projects, Master Plans, Detailed Planning Projects Land Surveying, Building Blocks Of Urban Nodes And Other Elements Of Planning Structure Of Settlements; 
2-2) Master Plan - Urban Planning Documentation On Potential Urban Planning Development Areas Of Urban And Rural Settlements; 
2-3), Urban Development (Hereinafter - Urban Planning), The Activities Of State Agencies, Local Governments, Individuals And Legal Entities In The Field Of Urban Planning Development Areas Of Urban And Rural Settlements, Certain Uses Of Land, Design, Construction And Reconstruction Of Houses In Accordance With The Kyrgyz Republic Legislation; 
2-4) Degraded Agricultural Land - Land That Have Lost Their Original Useful Properties To The State, Excluding The Possibility Of Using Them Effectively For Their Intended Purpose; 
3) Land Share - A Plot Of Land For Agricultural Purposes, Provided The Citizen Of The Kyrgyz Republic In The Manner Determined By The Government Of The Kyrgyz Republic; 
3-1) Town-Planning Regulations - A Set Of Established Town-Planning Documentation, Building Regulations And Land-Use Options And Types Of Permitted Use Of Land And Other Real Estate In Urban And Rural Areas, As Well As Acceptable Change Properties In The Implementation Of Urban Development Activities; 
3-2), Public And Social Needs - Needs Related To National Security, The Environment And Objects Of Historical And Cultural Heritage, Accommodation And Social Service Facilities, Industrial, Transport, Energy, Engineering, Architectural And Construction Documentation, Development Of Mineral Deposits , The Implementation Of International Treaties Of The Kyrgyz Republic; 
4) Land - The Land Area Of ​​The Closed Borders; 
5) Land Under The Apartment Building - Section, Which Includes Territory Adjacent To The House, Including Green Spaces, Shopping, Children's Playgrounds, Playgrounds Equipped For Collection Of Solid Waste, And Other Areas, The Boundaries Of Which Are Determined By Regulation Of The The Established Order; 
6) Land Fund - All The Land Located Within The Borders Of The Kyrgyz Republic; 
7) Land User - A Natural Or Legal Person, The Right To Use The Land Is Granted, Transferred, Or Turned Into A Perpetual (No Fixed Term) Or Fixed-Term (Temporary) Use; 
8) State Land User - State Enterprises, Institutions Of The Kyrgyz Republic Who Have Received Land In Perpetual (No Fixed Term) Or Fixed-Term (Temporary) Use; 
9) Municipal Land User - Municipal Enterprises, Institutions, Organizations, Received A Land Plot For Termless (Non-Fixed Term) Or Fixed-Term (Temporary) Use; 
9-1) Zone (Scheduled Area) - An Area In Relation To Which (And, Accordingly, All Land Plots Located There) Is Set Planning Regulations; 
10) The Foreign Person - Foreign Legal Entities, Foreign Citizens And Stateless Persons, Be A Party To Land And Legal Relations; 
11) Foreign Legal Entity - A Legal Entity That Has One Of The Following Features: 
A) Established And Registered In Accordance With The Laws Of A Foreign Country; 
B) Fully Owned By One Or More Foreign Individuals Or Legal Entities; 
C) Controlled Or Managed By One Or More Foreign Individuals Or Legal Entities By Means Of: A Written Contract, The Right To Sell The Majority Of The Voting Rights, The Right To Appoint The Majority Of Members Of The Executive Or Supervisory Body; 
D) Registered In The Kyrgyz Republic And Having Not Less Than Twenty Percent Of The Share Capital Held By Foreign Citizens, Stateless Persons Or Entities Referred To In This Paragraph; 
D) Created On The Basis Of An International Agreement Or Arrangement; 
12) Category Of Land - Land Used Or Intended For Use For The Same Purpose; 
13) Low-Productive Agricultural Land - Agricultural Land Having Low Power And Unstructured Soil Layer With Low Site Class Score And Requiring Large Expenditures For Their Amelioration, With The Exception Of Pasture; 
14) The Authorized Government Agency - The Bodies Specified In Articles 13-17, 20, 21 Of This Code; 
15) Especially Valuable Land - Irrigated And Drained Lands Intensively Used Agricultural Land (Irrigated Arable Land, Land Occupied With Perennial Fruit Plantations, Vineyards, Cultivated Pastures, Hayfields And Pastures Radical Improvement), Lands Occupied By Protective Forests And Equivalent Greenery, Land Suburban And Green Areas, Development Of Experimental Fields (Polygons) Research And Educational Institutions; 
16) The Allocation Of Land - Allocated (Allocation) Of Land With The Establishment And Fixation Of Its Borders In The Area On The Basis Of The Decision Of The Authorized Body;

17) The Transfer Of The Right To Land - Alienation Of The Owner Or Land User Rights To The Land Or Transfer It For Temporary Use To Another Person By Committing Civil Transactions; 
18) The Transition Of Land By Way Of Universal Succession - The Emergence Of Ownership Or Right To Use The Land In Inheritance Or Reorganization Of A Legal Entity; 
19) The Right To Land - Ownership Of The Land Or The Right Of Perpetual (No Fixed Term) Or Fixed-Term (Temporary) Use Of Land; 
20) The Right To Use A Land Plot Being The State Or Municipal Property - The Right To Perpetual (No Fixed Term) Or Fixed-Term (Temporary) Use Of A Land Plot Being The State Or Municipal Property; 
21) The Right To Use The Land - Property Right Of Natural And Legal Persons Who Are Not The Owner Of The Land; 
22) The Ownership Of The Land - Recognize And Protect The Constitution Of The Kyrgyz Republic, This Code And Other Legislative Acts Of The Right Of Individuals And Legal Entities At Its Discretion, To Possess, Use And Dispose Of Its Land To The Limitations Established By This Code; 
22-1) Zoning Regulations - The Activities Of Local Authorities And Specially Authorized State Bodies In The Development And Implementation Of Building Regulations And Land Use Areas Of Urban And Rural Settlements; 
23) The Provision Of Land Rights - The Provision Of The Authorized Body In The Ownership Or Use Of Physical And Legal Entities Of Land Owned By The State Or Municipal Property; 
23-1) The Rules Of Construction And Land Use Areas Of Urban And Rural Settlements (Hereinafter - Rules Of Building And Land) - The Normative Legal Acts Of Local Government Bodies And Specially Authorized State Bodies Regulating The Use And Construction Of Real Estate Changes Through The Introduction Of Town Planning Regulations; 
24) Croft - Do Not Put On, And A Land Plot Allocated By State Or Local Government To Citizens For Individual Housing Construction, With An Adjacent Site; 
24-1) Permitted Use Of Land And Other Real Estate - The Use Of Real Estate In Accordance With The Town-Planning Regulations Laid Down In The Planning Documentation Of Human Settlements And Land Use And Building Regulations, As Well As Restrictions On The Use Of These Objects, Established In Accordance With The Legislation Of The Kyrgyz Republic, And Easements; 
24-2) The Market Value - The Most Probable Price At Which The Evaluation Object Can Be Disposed Of In The Open Market In A Competitive Environment Where The Parties Of The Transaction Are Reasonable, All The Necessary Information, And The Value Of The Transaction Price Is Not Influenced By Any Extraordinary Circumstances; 
25) Garden Plot - Land Plot Allocated By State Or Local Government Enterprises, Institutions And Citizens Of The Kyrgyz Republic To Organize A Cooperative Horticultural Partnership For The Production Of Vegetables, Fruits, Including Agricultural Products; 
26) Agricultural Land - The Land Used For The Production Of Agricultural Products, Namely Arable Land, Fallow Land, Land Occupied With Perennial Plants, Hayfields And Pastures; 
27) Easement - The Right Of A Person To The Limited Targeted Use Of The Land, Owned Or Utilized By Another Person; 
28) The Official Land Plot - A Plot Of Land Provided By The State And Municipal Land Users To Their Employees In Order Prescribed By This Code; 
29) State Fund Of Agricultural Land - Land Formed From Agricultural Land (Except Pastures) And Being In State Ownership; 
30) The Purpose Of The Land - Use Land For The Purposes Specified In The Documents Certifying The Rights To A Land Plot In The Contract Or Other Documents Of Title; 
31) State Reserve Land Mineral Resources - Land, Under Which Explored Mineral Deposits, Accounted By The State Of Mineral Resources Of The Kyrgyz Republic; 
32) The Authorized Body For The Implementation Of The State Policy On Subsoil Use - The State Body Determined By The Government Of The Kyrgyz Republic And Provides Land For Subsoil Use Of The Lands Of The State Reserve Lands Of Mineral Deposits.
