Mr. James Sloan is a partner in the commercial Fiji law firm Siwatibau and Sloan - sas.com.fj James qualified as a barrister in the UK in 1999 and was admitted to the High Court of Fiji in 2003. James has a busy environmental practice with a particular emphasis on marine conservation, oceans governance, and the law of the sea. This has included the following highlights:
- In 2008 along with other dedicated individuals James assisted with the founding of the Fiji Environmental Law Association (FELA.org.fj) and chaired the Executive Management Committee of FELA for 10 years from 2008 to March 2018 in a pro-bono capacity.
- Lead counsel in the case Ramendra Prasad V Total (Fiji) Limited (Civil Appeal No ABU of 2018) where Fiji’s Court of Appeal on 28 February 2020 found that Total was negligent and liable for an underground fuel leak establishing the “polluter pays” principle in Fiji law, as well as affirming the actions and findings of Fiji’s Ministry of Environment in relation to Total’s negligence.
- Working with Fiji’s marine conservation NGOs, various donor agencies, and key government Ministries to find innovative ways to coordinate and support Fiji’s international and regional leadership and commitments in relation to oceans and climate change.
- Lecturing and coordinating 2 undergraduate courses within the School of Marine Studies at the University of the South Pacific (USP) Law of the Sea (MS205) and Ocean Governance (MS304).
